Child born abroad with ILR, parent on ILR. Is child eligible for British Citizenship?

Hello All,

My son was born in India in 2009 and residing in the UK since 2010. Me, wife and son received ILR status in 2014. My daughter was born in the UK in 2014 and is a British Citizen.

Question:
I plan to apply for mine and my son's BC later this month. Is my son eligible?

Section 3(1) in the the MN1 guide states that
"Children born abroad to parents who are applying for British citizenship
Where one or both parents are applying for British citizenship they may apply for one
or more children who are not automatically British at birth (see “Automatic acquisition
of British citizenship” above) to be registered as British citizens as part of a “family
application”. Children in this category will be considered at the Home Secretary’s
discretion and will usually be registered only if both the parents are granted or already
hold British citizenship, or if one parent holds British citizenship and the other is
settled in the UK.
".

Does this mean either me and my wife should be a British citizen before we can apply for my son's British Citizenship?

Any advise will be helpful.

Thanks in advance.
Vijay

Yes. They expect that. But it should be okay, if your son applies together or after you, provided you are successful.

Applying for British Citizenship, with passport about to expire in July 2018

Hello All,

I plan to apply for British Citizenship early March before the fee hike. My Indian passport is about to expire in July 2018. I have travel plans from end of June 2018 to mid July 2018. The earliest appointment date at VFS London for reissue is 06th March and it will take 3 weeks to receive the new passport.

I am assuming it will take at least 6 months for my BC approval to come through. Can I submit my application for BC with my current passport and later obtain a new Indian passport to travel to India?

Just concerned that the AN form requires the current passport number and if I get a new passport, the old passport will be cancelled.

Please advise.

Thanks,
Vijay

Should be okay as your passport is current at the time of the application. Suggest use NCS.
