Gap of 3 months

Hi i want to apply for naturalization I married with my wife on 15 Dec 2009 student visa expires 23 Dec 2009 apply for residence card after 3 month of gap. After 6 months they issue me 5 years of residence permit. Did this gap they consider or not.

Was your wife a non-UK EEA citizen or a British citizen at the time of your marriage? Were you issued a Residence Card (under the EEA Regulations) or a Residence Permit (under the UK Immigration Rules)? You need to be precise in your choice of words for us to advise you correctly.

I married to polish citizen and I got 5 years residence card (under the EEA Regulations ) now I got PR in 2016. We are separated now want to apply naturalization.

You became an EEA family member bf your student visa expired. The 3 months gap does not matter as it is not compulsory for you to have a residence card. It should not have an impact on your naturalization.

Overview
You don’t currently need to apply for a document to prove you can live in the UK unless:
you’re an extended family member of someone from the European Economic Area (EEA) or Switzerland
you want to apply for British citizenship
you want to sponsor your partner’s visa application under the Immigration Rules.
From the info you have provided, you are a direct family member and you were not in breach of immigration rules so, the 3 months gap that you refer to will not affect your naturalization application.

Thanks for brief answer
we are separated now about to proceed the divorce and my Solictor says that you got PR from the date of PR you are not anymore under eea umbrella. Normal british rules applies on you.
Please shed a light on this.

Your divorce will not have an impact on your naturalization application as you are a permanent resident if that is why you are asking.

Brother you know anyone who was in the same situation cause my solicitor says you can't Need Help
