Hi everyone,

I am currently living and working in UK on Tier 2 Intra-company transfer visa but I will be giving birth in June this year outside of UK in Taiwan. As my husband is British citizen by descent (we were married in UK in 2016), I understand my baby will be British by descent. Since we are planning to stay in Asia until baby is around one years old, I am trying to understand what's the best process to take once we need to enter UK next year:

1. Do I need to register my baby’s birth immediately online? Or when is the latest time I need to register this by? As potentially it seems more hassle free/cheaper to register baby's birth when we are back in the UK which potentially could be a year after baby is born.

2. Could my British husband who is going to be back in London one month after the baby is born register (online) and then apply for the UK passport (without baby being in UK) via post office for the baby rather than us doing it all online overseas?

3. Or would it be ok for me to enter my baby into UK with a Taiwanese passport first with my husband then after we are in UK, apply for British citizenship and passport in UK (Taiwanese passport is 6 months visa free for UK) and when do I need to do this by?

4. Will there be any implications from point 3 on my UK spousal visa application as I will be applying for it this November (currently on Tier 2 Intra-company transfer visa expiring end of November) if following point 3 route (before the baby is registered as British and getting his British passport). Would the Home Office treat the baby as a separate case and the baby just falls under his British Dad...or this would impact my UK spousal application?

No. If husband is British by descent, then baby born outside the UK may not be automatically British.

Where and when (year) was your husband born? At what age did he acquire British citizenship? How long has he lived in the UK?

Thanks for coming back! Sorry that was a typo! He is British other than by descent as he is British born in London with British parents. So yes, his child does get British citizenship by British by descent. He is born in 1984 and has lived in Britain all his life except 5 months in Philippines once.
