thanks for replying.

i was reading guidance and i came across this

If you are married to or the civil partner of a British citizen, you will need to be free
from immigration time restrictions on the date you make your application.

If you are not married to or the civil partner of a British citizen you should have been
free of immigration time restrictions during the last 12 months of the 5-year qualifying
period.

the way i read this is if i am married to BC and i have ILR and i can apply. if someone is not married to BC they will have to wait for 12 months......????

You can apply now if you meet the 3 year residence requirement, including the absence limits and being physically present in the UK exactly 3 years ago on the date you apply for BC.
