Hi

I have an Indian passport was granted ILR from Tier 2 ICT Long Term in Oct 2014.

My son was born in 2013 and was under Tier 2 ICT dependant in 2013 later extended to PBS dependant in 2015.

Can I now apply for British citizenship by naturalisation for him as a child of person with ILR? Or does he need to get an ILR first, then wait 12 months to be naturalised?

Best regards.

Yes, if he was born in the UK. Otherwise, no.

Yes, if he was born abroad. Children born abroad have the UK Immigration status of the less-privileged parent, so the child will acquire ILR with the second parent and can be registered when one parent has become (or is applying to become) a British citizen AND both the child and the second parent have ILR.

No need to wait for 12 months if the conditions above are met.
