Brtisih citizenship for my to be born child

Hello Everyone,

Firstly, please allow me to thank everyone for their valuable posts and comments, this board is a treasure trove of useful guidance and hints for lot of confused (and often distressed) souls. Moderators - fabulous work to ensure that all topics remain focused on the issue at hand.

Context:
1. I currently hold ILR and my wife is on tier 2 PBS dependent visa. We are expecting our first baby, and are considering giving birth abroad for better support and enhanced care.
2. Our baby is due to arrive late in January 2019
3. I am eligible to apply for British citizenship in April 2019

My query is:
If we chose to give birth to our baby overseas (outside UK), would I be able to obtain British citizenship for my little one ? If yes, then how and what route would it be ? (In particular, would I be able to apply for his registration as a British national - when I submit my application for British Citizenship in April 2019)

No you cannot. Child would only be British by descent if you are already British at the time of the child's birth. No special provisions if you only hold ILR and child is born abroad.

No. The child will follow the same visa path as the mother, PBS Dependent and then ILR and then Citizenship.

If child is born in the UK, the child is automatically British and can apply for a British passport directly (one week fast track service is available for this).

If you (one parent) holds ILR at the time of the child's birth;
If child born in the UK
  • Child is a British citizen automatically
If child born outside the UK
  • Child's UK immigration status will be inline with that of the less-privileged parent. S/he can register as a British citizen when at least one parent is a British citizen AND both the child and other parent have ILR

If you become eligible in April 2019, assume that optimistically it takes only a couple of months for your application to be approved and that it takes a further month to attend the citizenship ceremony. At the earliest, you will only become a British citizen in June/July 2019, well past the child's due date.

If you wish the child to acquire British citizenship, it may be best for the child to be born in the UK.
