I am an eea citizen with PR, I am married to non eea however he also holds PR. My daughter 7 (era) lived in the UK for 6 years ( not born in the UK) is applying with me for a British citizenship. Her dad isn’t applying with us as he still didn’t meet the 12 months after PR (settled status).

My question is, I am really confused which act I should apply for her under 3(1) or 3(5)?
Apparently lots of applications get refused for applying under the wrong act :s

I am applying under 6(1).

She can only apply under section 3(1).

Section 3(5) is only relevant if you are Brirish by descent, which you are not.
