I have got ILR in March 2018 and my daughter born in india in Aprill 2018.She came to UK on PBS dependent child visa (my wife has PBS dependent visa) in september 2018 and her visa is going to expire in January.
I have got two questions :
1)is my daughter eligible to apply for British citizenship.(i recently took appointment with immigration advise r and he told me that my daughter is eligible for citizenship. But , i am not sure she is eligible as i only held ILR when she was born)
2) my wife has been staying in UK since March 2013 on a PBS dependent visa. She stayed in india more than 6 months time from september 2014 to january 2016 and September 2017 to September 2018.She had to go to india for her pregnancy .Is she eligible to apply for ILR ?
Thanks in advance for your help to answer my queries.

No she is not eligible for British citizenship. She would have been British if she had been born in the UK.

There is NO absence limit for PBS Dependents whose visas were issued BEFORE 11 Januayr 2018. You can apply for ILR for your wife and child at the same time.

To add to CR001's reply, the child will be eligible to register as a British citizen after both the child and mother has ILR AND at least one parent either is or is applying to become a British citizen.
If the child was born in the UK, the child would have been born a British citizen.
Given the cost of getting ILR for the child and then registering them, the decision to have the child born outside the UK was an expensive one.

Thanks for your prompt reply.
i have one more question about the ILR eligibilty for my son.He born in India May 2015.he came to UK in January 2016 on PBS dependent child Visa. His 3 year visa is expiring in January .Is he also eligible to apply for ILR along with my Wife and daughter (who born in April 2018). If he is not eligible for ILR , we should apply ILR dependent visa for him.

My wife just passed the life in UK exam and submitting her ILR application today (super priority service).i came to know that sometimes it takes time to get decision though I chose super priority service.my wife and son visas are expiring jan5th and I would like to apply ILR for my son and daughter based on the wife ILR.In worst case, if my wife ILR visa decision take time, what visa options I have for my son and daughter. Thanks in advance for your kind help.

You should have applied for all of them together. You must apply for your children before their visas expire.

If her visa is rejected, then their visas also will be rejected.so I am thinking to apply for my wife first and then kids.

She has official transcript to prove her degree was taught in english.she is not submitted the application yet.i am planning to submit tonight.sorry for distraction from my above question .i have a confusion about the question in ILR application about the do you or partner receive any public funds?
I suppose to say yes as I am receiving money after I got ILR.
Coming back to apply for IlR for my wife, son and daughter, in case my wife visa rejected all their visa rejected and I may lose lot of money.Do you see any
Best way to submit their application. I appreciate your time and help for your quick replies.

If the degree is a foreign degree, she needs UKVI red route NARIC English assessment AND comparable assessment.
The degree and transcripts alone are not sufficient.

Hi,
Sorry if I am asking any repitive questions those have been already answered .
My wife is submitted her ILR visa application and got the appointment for super priority service
1)I wonder is there any time restrictions to apply for ILR before the current visa expires?
1) if no restrictions, is submission date before expiry date is taken into account or biometric submission date at premium service center?
Thanks for your help.
