Caution

I applied for citizenship as a husband of a British citizen in July. I received a caution in August and I was told by the police that they already informed the immigration about it since they had to inform the home office under new law and it will come in the system when they do their checks. I received a letter saying that I haven’t disclosed it so am banned for 10 years. What do I do? I had a lot to deal with and I geneuinly assumed they knew about it and the police registered it so my duty to notify them ended.

Banned for 10 years... from reapplying I assume?

Nothing much you can do apart from applying for reconsideration, but you failed to disclose so not much chance of it being overturned.

I applied for citizenship and during the time my application was considered I revived a common assault caution for a minor sensitivity incident with my partner. I then received a letter saying that I can’t apply until 10 years. My ILR expires before then 10 years and am worried that I won’t be able to review it because of this. I wasn’t at all deceitful, in fact I just had lots on as moved out of home etc. What are you thought about this? What should I do?

ILR status does not expire.

Well it has an expiry date of 31/12/2020

Are you referring to the date on your BRP card? Is this the card expiry date - not expiry of ILR - you apply for a new card.
Please clarify: you declared the caution in your AN application? What is the exact wording of the refusal?

If you got "ILR" in June 2018 and it expires in December 2020, then I think you might be mistaken and were issued with a further period of 2.5 year leave to remain or a visa and not ILR. A BRP for ILR would expire in 2024 not 2020.

You are also not married to a British spouse if you got married Islamically within the UK. You are unmarried for the purpose of citizenship as you were already advised last year when you asked the question.

Can you state exactly what your BRP says is your visa category as I have asked?

Does it state 'settlement' or 'indefinite leave to remain' or does it say something else?? The expiry date of your BRP card indicates you have not got ILR.

Sorry it expires in 24 you are right. But can I renew it with this problem? Also what options have I got now? I did send a reconc request form NR
