MN1 for child born outside of UK

Hello,

My husband :

Tier 1 General -> April 2011 - March 2016
ILR. -> April 2016
Naturalisation. -> May 2017
British Passport -> Nov 2017

My son born in india (Dec 2014) when husband was on Tier 1 General and I am a PBS Dependent Partner - Tier 1 General

My Daughter born in UK (british citizen by birth got her british passport) when husband was on ILR.

Questions :-


1) Can I apply my ILR (PBS Dependent Partner - Tier 1 - 5 year route) on May 3rd, 2019 alone without applying for my son ILR application with me? or do we need both to apply for ILR at the same time since born outside uk?

2) After getting my wife ILR immediately can I apply for MN1 for my son (Section 3(1) : Home secretary Discretion) without applying ILR for my son? If yes, Will his MN1 gets approved

Child born outside the UK is expected to hold ILR even if you choose to apply under section 3(1)
