ILR to Citizenship

Hi,

Me and my family granted IRL in February 2019. In order to apply for British citizenship we need to stay in country for least 12 month out of which we shouldn't be living outside UK more than 90 days.

My employer is asking me to move to MiddleEast by August/September this year. Which means my stay in country will exceed the 90 days limit by February 2020. I was reading Guide AN and it says that total number of absence days (101-179 days) normally disregarded if one can demonstrate links with UK through presence of family and established home.

So my question is that if my family doesn't move with me at the beginning and stay in UK and my stay outside UK is less than 179 days will I be eligible to apply for BC. Besides this I could get a letter from my company stating that I am required in another location for a special project. I was granted ILR through Tier 2 General route through the same company.

Any risk that my application could be refused?

Yes there is a risk. Citizenship is granted to people who generally intend to live and work here. Staying more than 90 days outside the UK will show your intentions are otherwise.

Also keep in mind that a long absence from the UK may imperil your ILR.

You may want to ask the company to wait until you get British citizenship and a British passport before they send you abroad.
