Hi,
I saw a few threads on this but can't quite understand what happens if the child does not have a valid visa to return. So asking again here..
Baby born in UK an parents got Ilr 2 months back. The child's Mn1 application in progress and we are travelling to India end of July as its been a year since he was born. He has a valid Indian passport and he does not hold a visa.
1.) is he allowed to travel while the application is in progress?
2.) The baby is going to be with mom while I return back in 2 weeks time. If I get the registration by then, can I apply for british passport in UK while the baby is still away in India?
3.) if I dnt get it by end of August while the mom and baby have to return what are my options?

Your baby needs visa or ILR to return unless granted British passport or
COE

Sorry for the delayed reply. Iam still waiting for the registration and its been 2 months.
Would I need to bring back my sons Indian passport when I return back to UK? My plan was to take him on his Indian passport, come back a bit early and if the registration has come by then, apply for his passport while he is still there in India.
So should I bring back his Indian passport? Do I need to send that as part of his application in UK?

Not really but as far as I know Indian citizens are not allowed to hold dual nationality and should renounce their Indian nationality when becoming British. So I assume you are going to surrender their passports to the embassy after your kids are granted citizenship here

Which should be fine zimba. If I bring it along with me here, I can surrender once I get his BP. And find a way to send the BP to India for him to return.. It's just thst there are too many variables in here which is confusing..

You need to send his Indian passport to HPO while applying for his BP.

Thanks sun26. Big dilemma as whether we should apply for a visa as we both have Ilr before we leave UK or apply for someother visa while back in India. In which case I can't carry the passport back.
Rest of the family is planning to come back end August which is 4th month from application filing date.. What happens if I still haven't got the registration certificate

Hi,
Sorry if this is under the wrong section. Me, my wife and eldest son have ILR and our youngest was born in UK. I didn't apply for any visa as the plan was to apply for his passport thru mn1 application.
Now we have to travel in end of July and its already been 2 months since we submitted the registration and kind of in dilemma as to what to do and how the little one will return back in August when family comes back as he does have a valid visa.
One option was, me and my eldest are returning mid August which is abt 3.5. Months since application date and if I had received the registration, I can Bring his Indian passport to UK and apply for british passport and then somehow get the passport back to mom and baby in India. Question is what if the registration doesn't come thru..
Are there any visas that I can apply from within UK in this 1 month period before we fly as we both hold ILR?
Once in India can we apply for any type of visa to join family?? How long would that take?
Any help is greatly appreciated

Assuming child is not British by then, and they will see he has a pending application, a settlement visa can take up to 90 days, sometimes longer.
