Physical presence requirement

Post by ellyell » Fri Jul 12, 2019 11:54 am

Hi All,

I have recently received my BRC-Settled Status (Surinder Singh case) and now planning to apply for citizenship.
Any advice how to prove I was physically present in the UK on the first day of the qualifying period (3 years), what would be the accepted/preferred evidence? I have not been getting any stamps on my passport.

Thank you,

Council tax bills, payslips, P60s this is to prove you’ve been living in the uk. I am not sure about the The first day of qualifying period, they probably have that information anyway. But maybe other users can advise.

There is no specific requirement to prove that date - BUT your residency proof must cover that date, as required by the British Nationality Act.

Your non EU passport should be stamped showing all your entries and departures. That is sufficient.

Non EU passports are stamped on arrival and departure. I dont know how you did not get stamped. Its good to apply for an SAR and you will know exactly what HO has on you. SAR take about one month from date of application.

If you read the users first post, they were under the EEA FM Surinder Singh route and their passports do NOT get stamped even as non EU!!

Good to learn that those under FMA, the Surinder Singh route do not get stamped.
