Hi All,
Hope everyone is fine and happy , i am preparing my file for the naturalisation and i need to clear few points related to my application .
I would like to mentioned that with the help of this platform since 2013 i getting very professional guidance.
My Questions are below.
1- My wife is a EU national and has obtain her Certificate of naturalisation few weeks ago but he has not apply for British passport yet. I am a non EU national and hold a PR since last year August my question is do i have to Waite till august or i can apply now because my have obtain a certificate of naturalisation.
2- As per guidance if i am married to a British citizen than i have to mentioned the absence from last 3 years ?
3- As per guidance note if you are a partner of a British citizen on page 6-You must not have been in breach of the immigration rules in the 3-year period before making the application (see the section on Breach of Immigration Law). but on PAGE 8 of the guidance note saying -
Just because you were given indefinite leave to remain does not mean that we will automatically disregard the time you were in breach of immigration laws during the residential qualifying period. Any immigration offences will also be considered as part of the good character requirement. This includes immigration breaches in the10year period before you apply for naturalisation – see the section on good character.
My question is do i have to satisfy the HOME OFFICE for last 3 years or since i came to the UK as a student in 2009?
Thanks in advance...
God Bless you all..

Provided you have applied for and received a PR Card, you can apply now. You will need to submit your wife's naturalisation certificate as proof of being married to a British citizen.

Correct. You also need to submit proof that you were within the UK exactly 3 years (to the day) before the date of application.

You need to meet the good character requirements for the last 10 years.

Thanks for the reply,
Please clarify few points.
1-
While putting my employment history for the last 10 years can i put part time on the application form during the period of my student visa when i was allowed 20 hours and then 10 hours a week ? I was working part time from 2010-2013 (i was allowed 20hrs and then after extension i was allowed 10 hours a week)And how can the home office and HMRC can find out if some is working more than 20 hours a week if they are allowed only 20 hours?
2-
Asking to home office for IMMIGRATION HISTORY SAR (subject access request) can effect on the application. Actually i am thinking to make sure that everything is clear before i send my application?
3-
I had a CCJ Against me in November 2013, which i had paid the all balance in 2017 and also had a letter from the court saying that balance if fully paid and the judgment is satisfied . Will this going to effect on my application?
Thanks in advance.

I am not experienced user but can comment on point 1,2.
1- To my knowledge HO may or may not check the overall income/employment from HMRC. I requested my 10 year employment history from HRMC, it arrived after 30-40 days in form of a letter. HRMC advised if HO request employment history from them, then they provide income/income tax and national insurance against each employer in table format as they provided me. All information is listed as per tax year, not monthly. Letter I received from HRMC did not mention employment dates rather listed all employments in a tax year, for example 2009-2010.
Usually if you work 10-20 hours a week then there will not be any NI and Tax on income. For example now a days if you earn more then £166 a week, then there will be NI deducted, similarly if the overall income gets above £12,500 then tax will be paid. During your student days if a large sum of NI/Tax has been paid, then "I think" it may cast a doubt, otherwise not.
2 - I don't think SAR from HMRC has to do anything with HO Naturalization application.
One of my friend got Naturalization and he did not list any employments from his student/psw years. He only listed employment from Tier 2 and to cover up previous years, he wrote was student in years he attended university.
Ideally you are suppose to list all employments in last 10 years, but I don't know if I will list all employments or not for my application, it was mostly cash in hand employments I did for 2-3 years (between 2010-2013) but they are all correctly recorded over HRMC NI record.

If you already have PR and can satisfy all the requirements you can apply now. If you will be relying on Settled Status for your application you will have to wait for 12 months from the date status has been given, that is sometime in 2021.
2- My wife holing a dual nationality EU and British means i have to satisfy 3 years residency. You don't have to prove the trips/residency out of the UK with passport stamps. You attach one of these documents for each year: P60, Employers' letter(s) confirming your employment(s) or other official documents showing your name, such as Council Tax bills, HMRC correspondence, DWP Child Benefit/Pension.

You only need to provide wife's passport and your marriage certificate - upload copies.
Suggest you take care of the damaged certificate as a replacement is expensive, though don't use sticky tape.
