Hi
Hope someone can help me.
I’m about to apply for British citizenship in a couple of weeks. this is my situation:
I arrived to UK on February 2002 with student visa, then I kept extend it till 2009 then I married my Swiss national wife in August 2009. my leave to remain finished in 31st Oct 2009 but I applied for another leave to remain on 21st November 2009 ( I applied 3 weeks late and had no idea about that I can apply through EU law) so my application was refused on 5th Oct 2010 based on my previous leave to remain that was expired when I made my application ( by 3 weeks). but with the refusal letter they sent me the EEA2 application which I applied then couple of months after I got my 5 years resident permit as a family member of Swiss national, then on Aug 2014 ( 5 years after my marriage) I applied for PR which i received after 8 weeks. now after 10 years of my marriage I want to apply for naturalisation,
Now I’m concerned if my application will get refused based on overstaying between 31/10/2009 and 21/11/2009.
Would you please advice me on this matter?
Thank you

During your "overstay" you were actually already married to an EEA National, therefore you had the free movement rights already, even if you hadn't had any documents to prove it.
I think you could apply for naturalization right away. You have your marriage certificate to prove that you had free movement rights during that theoretical overstay.

P60 is fine or an employer letter, not both. Useful to get a letter if you have been with the company for all that time, just one document.
