Child's British citizenship query

Post by sonirules » Sat Aug 17, 2019 12:50 pm

Dear Members,

I have recently received my Indefinite leave to remain. However, my son was born in Jan 2019 ( before I received my ILR).

I need to apply for his MN1 form and finding it difficult to understand what date should I mention in this question

Child has indefinite leave to enter/remain in the UK. Date granted:

As he was born 1 month before we applied for OLD he just has UK birth certificate. So wondering what date to mention As he doesn't have any biometric card.

Would also appreciate any suggestion regarding the same.

Thanks
Soni

His MN1 entitlement is based on the date of birth.

Thanks Simba. So just to clarify his date when leave to enter or remain was granted will be his date of birth?

Just to clarify he was born when I was under entrepreneur visa and 1 month after birth I applied for ILR.

Thanks
Soni

What travel or national identity document should I provide as he was born in the UK and has birth certificate only and no other document.

Thanks

Nothing. There is no need to provide travel documents. I repeat he is entitled to register without a passport/valid visa/BRP/etc. His date of birth is his date of birth :?

Is the profession on the list of approved professional referees?? Is the person a qualified whatever or just someone who teaches swimming?

She is a qualified swimming instructor. I am not sure if that's there in the list. Please can you provide me with the link?

I am afraid he cannot be a professional referee.

No it will not be sufficient.

You will need to find someone else. Pharmacist, religious minister, health visitor, etc.

Your son is few months old. HO is not strict when it comes to young babies referees. It is a known fact that GPs, health visitors and teachers dont provide one in majority cases. Just do what best you can provide. Add in a cover letter that you tried but GP and health visitor denied. Given the age of your son I dont think HO will be fussy.
If I was you I would add 3 British Citizen referees even if none knew the child in professional capacity.

Children acquire parents' nationality at birth

So the document checklist is asking for document to prove Indian nationality....which we don't have. So what document support do we provide? Parents passport?

No. Online list is not always accurate. Did you answer that you can provide a passport for the child ??!
I repeat again, MN1 for a child born in the UK to a settled parent is an entitlement. So there is no need to prove the child nationality

That is fine. Ignore the list as such document is not required for UK born children

Another thing in document checklist which they asked me to tick

If mr xxx told us that their parent is a British citizen then you must provide us evidence of their citizenship. This could include their British passport, a certificate of citizenship or their birth certificate.

I am checking the form and no way I said I am British citizen. What to do?

Thanks Zimba,

Doctors (Physicians) are not on this list as well ?

Does that mean they can not be professional referees ?

Technically that list is professionals who can act as referees for adult applicants and doctors are not acceptable as professional referees.
However the policy for child applicants is slightly different:
For child applicants at least one of the referees must be a person who has dealt with
the child in a professional role such as a teacher, doctor, health visitor or social
worker
. Where a child cannot provide a referee who has dealt with them in a
professional capacity and has provided documents to show that they have attempted
to do so, you can accept 2 referees who meet the criteria for referees on adult
applications.
This means doctors will be accepted as professional referees for a child application
