Hi all,
I have a question for naturalisation and register my child for British Citizen.
Currently I got ILR visa on 20th of August 2019 via Tier 2 5 Years application, and my child born in U.K.
My child visa is same length as Tier 2 dependent visa and expired already on 15th of August 2019. Because he is born in U.K. and he has Chinese passport and I heard if we not go out you do not need visa anymore so in this case I am going to apply for MN1 form for him now.

So my question is for applying MN1 form it asked you the child visa information but his visa is expired already. May I know is that an issue for him to apply MN1 form without valid visa anymore? Does he has to have valid visa for naturalisation?

Thank you.

A UK born child does not need a valid visa to apply for citizenship. They have an entitlement to register as British.

Hi yes I know this as long as one of the parent has ILR and child born in UK. But because we applied visa before as he went abroad before and now the Visa has been expired. So I am not sure is he in another category which is invalid visa staying in U.K.?

It applies to ANY child born in the UK. They DO NOT need a valid visa to apply for registration as British, whether they travel abroad or not.

Hi thank you. Do you know where can I find this reference because I can attach this as cover letter to the case worker in case.

Thanks.

HO know the rules and no cover letter is necessary. You are overthinking.
