Hi All,

Please my family got ILR about 2 yrs ago. My husband now has His British passport about a year now, I still have my ILR and not ready to do my naturalization yet .
However, I have questions on how to go about naturalization for my son who is about 8 yrs old that has ILR as well.

1. Is he required to live constantly in UK for a year as required for adults with ILR before processing the naturalization?
2. Which form will I be using to process the naturalization as he was born outside of UK

3. The ILR card I was given has an expiration date and I currently live outside UK , does that means I have to pay for another ILR when the expiration date comes .

Thanks for your time .

Children are registered as British. Only adults are naturalised.
1. Is he required to live constantly in UK for a year as required for adults with ILR before processing the naturalization?
No. The child does need to live in the UK if they were born abroad to be able to apply.
2. Which form will I be using to process the naturalization as he was born outside of UK
MN1. He needs to be in the UK to apply.
3. The ILR card I was given has an expiration date and I currently live outside UK , does that means I have to pay for another ILR when the expiration date comes .
How long have you lived out of the UK?? ILR is lost if you are absent from the UK for 2 or more years. The ILR BRP CARD is renewed.

Thanks for the prompt reply . So to clarify further ,
1. If the boy arrives in UK today , can I start the application right away since he has ILR and the dad is British / we have to wait for period of time to elapse before putting the application in ?

2. Can we fill the MN1 form online or has to be paper ?

3. I have been coming in and out of UK almost every year, atleast not outside for a period of 2 yrs .
4. If I want to do the naturalization, I believe I have to come in and live in UK too for a year or so , if I am not wrong?

Thanks again

1. Should be fine to apply yes.

2. Online only.

3. You do risk having your ilr cancelled on arrival if you do not reside in the UK. It does happen sometimes.

4. You will need to meet the requirements for citizenship and will probably need 3 years residence to meet the absence limit requirements.

So sorry to disturb again.

Since our son has ILR and the dad is British, can we do the registration as citizen from abroad, precisely from USA for him?

Secondly, is there a need for him to appear before home office?

Thanks πŸ™πŸ»

Morning,
Please I do not want to make any mistake with the registration for my son who is almost 8yrs old that is why I am asking for clarification before payment.

I and my son moved to UK in 2012 on my husband tier one visa. I and my son are both USA citizens.

The family all got our ILR in 2015. I relocated back to USA in 2016 with my son while my husband became a UK citizen through naturalization ( I believe that is called AN application), since then we have been going back and forth in UK almost every year.

However now we are planning for our son to do his registration as BC , I just want some clarification so as not to waste money .
1. Does the boy have to return to UK to apply for registration or can it be done from abroad
2. If he has to return to UK now , can we start registration upon arrival or have to wait for some time before submitting
3. How long does it take to return supporting documents for application
4. Hope there won’t be penalty for the boy for staying abroad .

Thanks again and again
