My father was born in 1967 and he moved to Australia in 1970. He has not been back to the UK since he moved.

I was born in 1989 to unmarried parents in Australia but I read that the domicile of the father may be presumed to be the country of his birth unless satisfactory evidence to the contrary is produced. In particular, if the father holds a passport issued by the authorities of the country in which he was born it can be safely assumed that the father has retained a domicile of origin, regardless of how long he has lived in the UK, and the relevant laws will be those of that country.

My father still has a Brittish passport so I’m guessing he is domicile in the UK. Will I be classed as legitimate considering I was born in 1989?

Australian children born out of wedlock have been legitimised since 1984.

If the laws of the country where the father is domiciled recognise the child as legitimate, then the child will be regarded as legitimate for the purposes of the British nationality law.
