10 year employment record

hi users,

my immigration history is

Jan 07 - arrived in UK as a student and worked cash in hand.
Jan 08 - Jun 13 - worked through Hays who supplied me to a contractor who then supplied me to an organisation to work for them. during the first year I may have worked over 20 hours while I was a student
Jun 13 - present - worked for another organisation without any issues

held the ILR since March 2017

my query is

1. Since the time when I may have worked more than 20 hours is past the 10 years (considering it was 08-09), would it make any difference to my application?
2. Since I was employed through a couple of agencies to the organisation i was working with during that period, who will be my employer? The first agency, the contractor or the organisation?
3. if it is the contractor, then I do not remember the date I started working with them as there were a couple of contractors during that period, how do I go about resolving this issue?

your assistance in this matter is appreciated.

If it was on a student visa and during term time, then yes as it was a breach of your visa conditions.
2. Since I was employed through a couple of agencies to the organisation i was working with during that period, who will be my employer? The first agency, the contractor or the organisation?
The agencies who paid your salary/wages.

If it was on a student visa and during term time, then yes as it was a breach of your visa conditions.
but the period of 2008-09 falls outside the 10 year period which the Home Office requires and check? will they go beyond the 10 year period to check the employment record?

can anyone please respond to my post?

I understand that I was in breach of visa requirements, but that was more than 10 years ago? my question is does it still matter? will the Home Office check the records beyond the 10 years?

Hi There,

Just order the 10 year employment history from HMRC, which will take about 30 days. Once you receive, you will see there is employer name/Income/NI and Tax columns. If you were working close to 20 hours, you will not have not paid any NI and Tax on your income, but if the income is well above a threshold where NI and Tax in big numbers being paid and you were full time student in that case, you might be in trouble.

HMRC will provide employment history of last 10 years from the day you or Home office will request them. Remember they workout employment history in terms of financial year not 10 years from the date of application. Means if you will request now they will include employment history from April 2009 to April 2010 year to date.

It would be difficult to say if earning above 20 hours will have an impact on your application or not, but in my understanding, they basically check if someone was working at the time when he did not had any valid visa.
