Physical presence 5 years before application

Hi All,

I submitted the naturalisation application in Jan 2020. At the time of the submission, I was unaware of the requirement that I need to be physically present in the UK, on the exact date, five years prior to the application date. As I was away on holiday, this requirement is not met with my application.

I received an email from the case worker, stating that this requirement is not met. However, in the email, they mentioned that in order for them to continue considering my application, I need to send them the attached copy of my submitted application.

-- Snippet from case worker’s email below:

"However, if you wish to send the attached copy of your submitted application form back to this address, we will be able to continue our consideration. Your application date will be the date that your re-declared application form is sent back to the email address."


1. From the text above, I understand that they are asking me to email them the copy of the application form which I submitted in January 2020. Is my understanding correct?

2. Or do I need to submit a new application online and send a copy of that?

3. Additionally, the case worker mentioned "re-declared" application form, however, there is no signature in the online application form, will sending the form over to them be considered as form of declaration?


Please advise.

1. Yes - as the email says "attached copy of submitted application"
2. NO - refer to 1.
3. If they haven't explained what re-declaration is then I would sign it at the end with date (make sure you were in the country on that date) - they can always come back to clarify but personally I would email the document to them ASAP.

Explain in your email what you have done and attached.
They've given you a second chance - the requirement to be physically present on the date 5 years back is a legal requirement (British Nationality Act) and they give you the option of re-declaration in most cases.

I will email them the document straight away.

Re the question about the declaration. Below is the declaration section at the end of the online application. the reason I wondered that sending the application is a form of declaration, because of the text highlighted in red.

Is my understanding correct, that by sending the application, I will be redeclaring it as well?

Or should I still, print, sign & date, scan and send the application form?

"DECLARATION

By sending this application, you confirm that to the best of your knowledge and belief the following is correct:

the information relating to the application the supporting evidence
Also, the application will be processed according to the privacy policy and terms and conditions.
If false information is given, the application will be refused and the applicant may be banned from the UK and prosecuted.

I am the applicant"

Hi All,

Please can somebody help me with my question above. Home office have asked me to send a copy of the submitted application form. Please see the text from their email below. However, there is no place to sign in the form. So how do I re-declare it?

My understanding is - since, the downloaded copy is already declared, me sending it over to them, will count as re-declaration. Is this correct?

Yes - correct - that's how I understand it.
