Regarding Neutralisation applying but had overstaying in 2010

Hi there,

I am wondering if someone can rectify me ?
I have Permanent residence since April 2019 and have got settled status in June 2019.
I had overstay in 2010 ,when i had refusal of my work permit tier 2 on April 2010 and it was mentioned i have 28 days to leave or appeal,i did ask to my solicitor to appeal ,he said he done that and kept asking him for evidence but he always said he is waiting from home office but he did lodge my appeal.
At 20-07-2010 i left UK voluntarily at my own expense informed to Immigration tribunal that i am leaving country and wanted to withdraw my appeal but they remained silent and made note.

I left UK and got CAS letter with me for PGD LEVEL 7 and returned to Pakistan and applied for tier 4 student visa within month but i had refusal from Home office saying that i was overstayed when i had refusal of my leave to remain of work permit tier 2 and i stayed there until 20-07-10 and didnt lodge appeal and that is why i am banned to UK for any immigration category until 20-7-11.
I did speak to my solicitor and asked him evidence again but he lied that he has and send someone to my office ,i sent many of my friends but he failed to provide because he did not lodge my appeal.

I waited until 20-7-11 and applied again for tier 4 and got visa and now i have settled status as i mentioned above.

Will it affect me if i apply for neutralisation before 10 years ?

I have mentioned to home office in my all immigration applications that it was not my fault and i never wanted to stay illegal in uk or overstaying ,that is why i come back at my own expense and tried genuinely for visa with college cas letter.

And last question when my 10 years are going to be completed ?Is it from 20-07-10 or i need to count from 20-07-11 ?
And when and which year exactly i can apply for neutralisation please ?

Your help and advice will be much appreciated .

Regards

You should not have any period of overstaying in the last 10 years from the date of your application counting backwards. This means you should only apply after 20-07-2020

Regarding British nationality applying date

Good morning,

Hi , i have question if someone can help me please as it’s confusing for me.

My actual applying date for neutralisation is due on the 20th of July 2020.

If I fill online application and book an service centre , depends on availability of Croydon one, so what will be the applying criteria ?

Means if I fill online application by the beginning of July and book an service centre appointment after 20th of July 2020 so will be ok for me ? Or applying date will be considered when I will fill online application ?

Because I want my submission date after 20th of July 2020.

So what’s the best way to do it please ? Do application online now and go for service centre after 20th of July or wait until 20th of July and fill online application ?

I want to be safe and I don’t want home office days that because you applied or filled online application before 20th of July so we refuse you and no refund .

Can someone help me please and give me right and appropriate answer

Many thanks
Faisal

Date of application is the date you submit and pay online and NOT your biomterics appointment date.
