Hi,

6 years ago I received a notification (From my home country) about a Traffic penalty: Driving a car and not stoping on a red traffic light.

At that time It was funny, because I didn't drive a car for years, and I was at that moment in the UK. So pretty easy to demonstrate this.

Obviously when I called them and told them about this, they said straight away, oh yeah, it's a mistake from an officer or civil servant picking the wrong person when adding the penalty in the system.

I did a formal complain, and it was approved.

I didn't know anything else about this, until I've checked the online application to check my driving points and records. I regularly check this just in case there is another mistake from the local police or the council.

Last time I've checked was 1 year ago and It was empty (only the full points and no penalties) , and now I see an appointment related to this penalty with some codes and one that can be translated to "Cancelled". The year is 2014.

Should I include this in my application? I've got a pdf from my formal complain (And the approved status), but it's in another language... Should I pay an official translator for this matter?

It's unbelievable that after many years.. they add an update on my records about their mistake! while It shouldn''t appear at all .

Btw the points are deleted off DVLA record after 5 years, how can you see points or cancelled from 2014?

Thanks for your reply. The wrong penalty notification was in my birth country and same with points, nothing to do with the DVLA.

My concern is, I have no idea how my birth country shares information with the United Kingdom. If my birth country made this update to my online points application less than a year ago, even the notification and the formal complain (+ the notification about the approval status of my complaint) was made in 2014... Maybe the United Kingdom can receive this as a fresh new penalty? And how they are going to receive the "Cancelled" status? I guess this is impossible to know, unless I try to do SAR in my birth country (but who knows if they can or they have records when this information was shared, if that happened at any point)

Reading the good character section says that I need to disclose any penalty. But mistakes from an officer too? Why did you say this is not necessary to disclose? Because it's too old or because it's not my fault but the public administration's fault?

If I decide to don't include this, and they find out by somehow (e.g. the cancelled status is not included correctly or they make a mistake in the translation), would they give me a chance to send more details? or can they reject my application straight away?

If I decide to include it, do I need to pay an official translator to traduce the formal complaint?

Firstly, it was in your home country that too 6 years ago.
You said you were in UK at that time so clearly it was issued by mistake and cancelled.
Secondly, you did not receive any conviction so this is not a recordable offence on your criminal record.
In my view, you are overthinking. If I was you, I would not declare it as there is no need for it.
FPN’s that lead to court and then you are convicted should be declared. If you settle a FPN before court/without a conviction, it does not come on your criminal record. Only if you have numerous FPN’s even without going to court, it may depict you of “not a good character.”
Plus I am pretty sure driving points from another country, can not be transferred onto your UK license anyways. Probably one can get a fine transferred depending on which country you get the fine, but can not transfer the points.
