Child Registration

I hope any knowledgable person can help us with this information.

A child born in 2004, parent not married at the time of her birth. she is in the UK since age 3yrs old till now,but she is 16yrs old now with 2.5 yrs FLR permit with her mum. she has two young sibblings age 12 and 6yrs old and father who were all British. Mother still on 2.5 FLR permit.

Miracle question,

We will like to try British Registration for her on DISCRETIONARY. {Just a try} on a compassionate ground.

What application form can we use? and any HO casework or people experiences helpful link to get info from as I have seen some here but they are very long ago and we thought policy may have change. I have managed to search for a form/apply online but I need guidance and advises from God sent people on this platform to direct us.

A child born outside the UK to non-British parents has NO entitlement to British citizenship at all. The child must follow the immigration path of the less privileged parent (her mother) under the family route and when both are granted ILR and settled, the child can be registered as British under section 3(1) by discretion. If by that time she is 18, then she should apply to naturalise instead.

Was father British otherwise than by descent at the time of child’s birth?
Did the parents subsequently marry? If so, then when was that?

Child may automatically be British or entitled to register, depending on the parents’ circumstances and relevant applicable Sections of the British Nationality Act 1981.

Thank you all for your inputs on this questions. But the section am referring to was Registration in the interest of a child under section 3 {1} on discretionary of the Home secretary.

In fact to my surprised. I have a family friend who both parent started with FLR FP before this year switching to FLR M 2.5 years first one with their daughter brought to the UK at six months old but now 16 years old. They also have a British 14 years old boy. And the daughter was very good in sport, she has represents both her school and even Manchester as a whole in her category and came first numerous times. including many awards from different places.

They apply for her and she was registered on discretion although the lawyer said from the beginning that it was 50/50 chance but lucky her! it took four months from early March this year.

Anyway, I have also read on this platform from a member that was approved without ILR for the child years back on discretion

Go read the guide I posted. I do not see any justifiable reason why HO should grant citizenship to such person under FLR. Such a move will be exceptionally rare

That's great to know. Certainly, HO saw a good reason to exercise discretion
