Hi there,

Hope you are all well with your love ones in this pandemic time. I need some help and would be very grateful that you can give me some advice.

I've just got my British passport(August 2020) and applied for my baby's British passport online(she was born in May 2020), and I am not sure whether there is only her birth certificate that I need to send. Or I need to send my new UK passport and marriage certificate as well?

This is the list:
Applicant’s documents
Send the following:
  • naturalisation or registration certificate
  • any court orders (for example that describe parental responsibility or residency arrangements)
-------------------------------------------------------------------------
If any of the following apply, you need to send additional documents:
  • include a professional, or other title on your passport
  • apply for a British National Overseas (BNO) passport
  • apply for a passport under treaty rights
  • change your gender on your passport
  • get a first UK passport based on your parents’ Crown or Community service
  • get a first UK passport if you were born abroad but adopted in the UK before 1 January 1983
  • get a first UK passport if you were adopted abroad and you haven’t naturalised or registered
  • get a first UK passport if you were born in the Philippines, or your parents are married or divorced and have links to the Philippines
  • apply for a first UK passport if you were born through surrogacy
  • apply for a British Protected Person passport
Thank you all in advance!

What was your status when your baby was born. Were you on ILR OR you were British (attended your ceremony) at that time already?

Edit: I can see you became British on 11th July.

If your baby was born in May, you need your ILR BRP as a proof for baby’s citizenship by birth.

Have you returned your ILR already??

Seema op only held PR at the time of birth.

You need to send evidence that you held PR or settled status at the time of the child's birth. Your subsequent citizenship after the birth is irrelevant.

Thank you, CR001 and CULLINAN.
You need to send evidence that you held PR or settled status at the time of the child's birth
But I have sent my permanent resident card back to HO after received my naturalisation certificate within 5 days requirement!!! I have my PR photocopy only! Should I send them home office approved PR letter and my naturalisation certificate? They will obviously know that I have PR before the baby was born. I didn't think this would be a matter, so regret that I sent PR back...

What can I do now?!

Unfortunately HMPO requires the original and will not accept any photocopies. This is a particular case where applicants get caught when babies are born on settled status and they return their ILR/PR card.

An EU route person with a PR card does not have to send it back once you become British as an EU citizen doesn't lose or status attained under the EU rules.

It is your PR card that is the proof of your child being automatically British.

It is only BRP cards issued under the UK immigration rules that have to be sent back as citizenships supercedes and invalidates UK rules ILR

OMG, I didn't know I can keep my PR card.

Does her father settle status counts too? he's granted on Indefinite Leave in the United Kingdom,
under Appendix EU to the Immigration Rules on 3 May 2019. So if I send HO the link(they have a link to prove, no paper but an email with a letter).

If settled status date was before the child's birth, then yes you can use that.

If you have the email, yes send that.

Yes, it's on 3 Mar 2019, it's more than one year ago before the baby was born(25 May 2020)

Can I ask you to check before I send? So I don't need to send my UK passport/naturalization certificate?

1. Baby Birth certificate
2. My HO letter approved PR letter and photocopy of my PR.
3. Father's email approved Settle status and the link with his settle status(screenshot)

Thank you!

Yes and hope HMPO accepts the above. Please update this thread later with an update. Thanks

I've just gone to post office sending documents. I will update here to see what happens. Alternatively, father's info(settled status on 3 May 2019 approved indefinite leave to remain) should be enough. Fingers crossed!

Thanks again to clarify and I hope no one making the same mistake I had, do not send back you EU route PR card!
