Back Story

My daughter was born abroad in 2016, my husband had ILR at the time and we submitted his BC application but he was unsuccessful. We did spouse visa with dependent instead and was successful and been here for the past 19 months.

We recently re-applied for his BC and he was successful, waiting on ceremony to be sworn in.

Can we now go ahead and register our child as British citizen? Using discretion?
I have received conflicting information. Should we wait for him to be sworn in or can we apply using his ILR and BC approval letter.

I have started to fill in her application and used the option of Parent applying for BC, and also if parent is denied to consider application on its own merit, but we did receive parents approval on 12.10. 2020

I know this is a discretion application and nothing is guaranteed, but just want to know if we have a strong case.

Any assistance will be great.

No. A child born abroad has no entitlement to register as British.

The child will follow the same path as you and require ILR when you apply before you can apply for citizenship for both of you.

If you take the risk, it is highly likely to be refused and you will lose the fees paid.

You don't have a strong case.
