Speeding offence and citizenship

Good afternoon,

I have applied for citizenship online but was a bit confused about speeding tickets as the form is not clear if you should mention these.

After reading this forum I understand that I should have.

I received a speeding ticket and filled in my details and sent it back, I never received the notification to make payment or send my license. It was then taken to court and I plead guilty. I paid the fine immediately and am waiting for contact from dvla to get my license endorses.

Should I send a covering letter explaining this when I got to upload all my docs as I don’t want them to think I am purposefully misleading them.

In this case, you have a criminal conviction. You should have waited 3 years before applying.

Fines
A fine counts as a criminal conviction and forms part of someone’s criminal record. Fines must be declared and may result in refusal if received within the last three years. Failure to declare may result in an application being refused on the grounds of deception. See

Ouch. Is it still worth sending a covering letter? Not much to lose at this point I imagine.

I would suggest you withdraw your application as you have not submitted your biometrics yet. You will get a refund. Apply 3 years after date of conviction.


Just to make it clear again. Your matter was taken to court and then you were fined by the court right?

Had the matter dealt with FPN only, you would have avoided a criminal conviction.

Would it be worth appealing the conviction now, I’m willing to hire a solicitor.

Yes, the matter was taken to court.

Yes, the matter was taken to court.
You already pleaded guilty so I am afraid that will not do you any good.

You must declare this anyways. Otherwise you may be caught for deception and forced to wait 10 years before you apply again.

You can write a cover letter and explain the situation. If you have a clean record and have no other convictions, CW may apply discretion.

However, note, if your application is refused you will loose the application fee.

If you are willing to take the risk to loose the fee, worth trying your luck.

Thanks for your replies. I have just spoke with the courts and they have advised I can appeal to the crown court.

What happens if you have an appeal pending in relation to the citizenship application?

Your application will be kept on hold till the appeal is finalised.
