Driving Without Insurance and BC

Post by vertical » Mon Sep 28, 2020 10:23 am

Hello All
I have two driving without insurance convictions

Aug 2015 - 6 Points and Disqualified . It went to court and i was moving my house at that time. Got redirection but never received any letter from courts at my new address. I found out once i received a letter from collector at my new address and paid it on the same day.

Dec 2017 - 6 Points .

I know it sounds stupid but at both times i was working for a relative and according to him i was insured under company policy. Dec 2017 i learnt my lesson and quit working for him.

Can someone advise me when can i apply for British Citizenship?
Do i need to declare both of them on my application?

Thanks

3 years after the date of conviction in Dec 2017.
Yes you must declare both in your application.

If you only have these two convictions, you will be okay.

However, multiple fixed penalty notices over a short period of time could demonstrate a disregard for the law and therefore demonstrate that someone is not of good character.

You must declare all FPN’s and convictions. BC is discretionary and up to the CW to decide.

In 2015 i moved to a new address and never received anything regarding my offence until i got a letter from Debt collects asking me to pay at my new address. I had redirection in place but i guess it never worked. I paid the fine same day. I had 6 points for speeding at that on my license so i got disqualified for 6 months in 2015.

In 2017 i got 6 points for the same offence but this year in December my licence will be clean.

What are my chances of British Citizenship?

Thanks

You have been advised already. Nobody can confidently tell you what your chances are. It might be at the discretion of the caseworker.
All you can do is declare all the three (2 driving without insurance and 1 speed ticket) and hope for the best.

You can also wait to see if you can any response from anyone in a similar situation in the past.
But at the end, you will have to decide if and when you want to apply.

All the best.

Hello

The problem is the risk to be perceived as a repeat offender. It seems you don't have lucky hand with vehicles.

There is risk that they pick up on that. No one can give you a percentage but the risk is definitely there.

In 2004, I had 2 driving offenses. Speeding and driving other than in accordance with a licence. In 2011, I applied for ILR and my immigration solicitor advised me that under the Rehabilitation of Offenders Act 1974, these offences are deemed "spent" and I am NOT required to mention them on my ILR application or anytime in the future. Under the Act the offences are deemed "spent" 5 years after conviction. I proceeded with my application as advised by the solicitor.

Of course I don't know if rules are different now compared to 2011 or different for ILR and BC.
