Hi,

I just thought to post on this thread itself as I am in the same boat but slight different case if you can help me.
I have recently got my ILR (through Tier 2). My wife's ILR is due next month and my baby is on PBS dependent visa which expires in Sep 2021. I wanted to apply Naturalisation for my baby minors under 18.

1. Am I right in thinking if one Parent has ILR then baby can apply for Naturalisation without having to apply for ILR.

2. And also in this case is it better that my wife applies for ILR first and then baby applies for Naturalisation
or do baby need to apply for Naturalisation before my wife applies for ILR. If any of this helps in either application.

3. Will they also need refrees?

Thank you for your help.

1. Yes but only if the child was born in the UK. A child is registered as British not naturalised, which is for adults. A UK born child does not need ilr or a valid visa to register as British.

2. Ilr for wife first.

3. Yes, two referees are mandatory.

2) If baby is born in UK. It does not matter if you apply ILR for your wife before registering your UK born child for BC.

But yes, if the child is not born in UK, child will apply for ILR when your wife applies for ILR first.

Naturalisation for baby born outside UK with one parent on ILR

Hello everyone,

Need help with below.

I recently received my ILR, with a lot of help from this forum. Now I am looking to apply naturalisation for my baby. My wife is still on Tier 2 dependent visa and will get ILR next month.
My baby is born outside UK and is currently on PBS Child dependent with visa valid until Sep 2021. I applied ILR after baby was in the UK.

Now my question is below.

1. Am I correct in assuming that I can apply for baby Naturalisation straight away without applying for their ILR (this seems to be expensive option), given they are born outside UK but since I have got ILR, and have settled status in UK.

2. My wife is due for ILR next month (Tier 2 dependent route 5 years), should she apply for it straight away or we apply for baby Naturalisation first. Will that help application?

3. Or should my wife apply fr ILR and then we apply for baby's Naturalisation as both parents will have ILR settled status.

4. If we go for option 3, Does Home Office need to know why we are not applying ILR for baby now? Since they are on visa till next year we could apply for their naturalisation later.

What are the best options for us in this case.

Many thanks.

Question 1 to 3 already answered.

4. No, ukvi do actually know the rules. You can add a brief covering letter if you wish.
