British Citizenship

Dear All,

Hope you are well and safe!
Could someone please kindly advise;

I have got ILR under Domestic violence and was granted 30 sept 2020, if I am not wrong can I apply for British citizenship after 30 sept 2021? (after 1 year).
if yes so another problem is my Indian passport going to expire on 15 august 2021, can I still able to apply for British passport with expired Indian passport or I have to renew the Indian passport first before apply.

I am bit confused and hopefully someone guide me the right path please!

How long have you lived legally in the UK?

Are you still married to your British spouse?

I came to UK in 2009 as student and I have done my masters, I got married to British citizen in 2016 and was under 5 years route.

Current situation; going through divorce.

Thanks for replying,

I came to UK in 2009 as student and I have done my masters, I got married to British citizen in 2016 and was under 5 years route.

Which stage is the divorce at?

Do you have access to your to-be-ex husband’s British Passport copy?

Second option:
You will be able to apply for AN application after waiting 1 year on ILR in your own right under Section 6(1) BNA 1981. You will have to fulfil 5 years residence.

Ideally you should have your Indian Passport valid on the date of application/biometrics appointment.

Many thanks for your reply.

I am at early stage of divorce (Waiting for him to apply for Decree Nisi), yes I do have his British passport photo copy. Could you please explain why would I need his passport photo copy?

By AN I mean, Naturalisation application.

The best will be to wait on your ILR for 1 year and apply in your own right as per Section 6(1) BNA 1981 after 30th Sep 2021. You need to fulfil 5 years residence in this case.

You do not need your to-be-ex husband’s passport copy or marriage certificate in this case. Your marriage status is irrelevant in this case also.

Hi Cullinan,

Thank you so much for clarification.

For now I will apply for renewal Indian passport first and also prepare for Life in UK test.
Is there anything else I have to prepare for?

You need Life in UK and meet the English Requirements also.

Google “life in uk web test” and you will find a website with 16 EXAMS (exams NOT tests). Do those 16 exams thoroughly and you will pass the test without any issues.

You also need a English B1 SELT:

Just last thing, I have done my masters MBA from London south bank university in 2014. does I still need English Test as requirement?

No. If your degree is from a UK university, you only need your degree certificate.
