Hi,

Good afternoon.

i'm planning to apply to Citizenship to my son who born in India (Mar 2015) while i had my ILR and my wife was in Dependent Visa.

Wife and Son started living with me in UK since Dec 2016 via Dependent Visa.
In 2017 i have got my UK Citizenship and Passport.
Aug 2019 - Their VISA expired and extended to another 2 years

Now,
1. Can i apply Citizenship for my son or should i wait to complete 5 Years ?

2. Should i apply ILR for my Son?

3. My wife will be completing 5 years next year so she can apply for ILR, am i correct?

Thanks in advance for your answers.

Thanks
Aravind

1. No, he doesn't qualify for citizenship yet.

2. Yes, he needs ilr first and must apply for ilr when your spouse does.

3. Yes and your son.

You were already advised about this for your son in 2019 when you asked. The advice doesn't change and remains the same.

No, it is not correct. It would only be applicable if he was born in the UK before you had ilr. Then he would have had an entitlement to register as British. Or if born in the UK after you had ilr, he would have been automatically British.

Being born aboard gives him no benefit or shortcut. He has to follow the same visa and ilr path as your spouse.
