Hi Friends,

I got British Citizenship in 2014 ( Via Tier 1, ILR Route ),
my wife and Son(born in india) were in India at that time. They moved to the UK permanently in 2016 as a dependent of a Settled Person (Family visa). Due to a change in the rules my wife and son had to do 5 years in the UK route to get ILR.

Now 5 years completed thinking of applying ILR for my wife with premium service once my wife gets ILR, apply my son Naturalisation directly without ILR on the basis of 1 parent British and 2nd parent settled visa(ILR).


We are in confusion with this, few people say not eligbile but when we spoke to the Homeoffice call center team says we can apply with the MN1 application, But they unable to provide in a written email saying covid as reason

As I understand its a risk as no clear information, is it worth applying to save £2400

Please share you experience.

If your son is born abroad, he needs to get ILR with the other parent first before being registered as British Citizen.

Thanks, CULLINAN. Do you think customer care gave us wrong information or not aware full criteria?

You were already advised in your other topic that the child needs ilr first. There is no shortcut route for children born abroad.

Note that the call centre is outsourced to a third party agent. You are not talking to ukvi caseworkers or advisors when you call.

Tell the family to read from Page 30 onwards of the Registration of children as British citizen caseworker guidance.

As a general principle, the expectation is that there should be a staged approach to permanent residence and citizenship. This means that the child will first achieve one of the following before being considered for British citizenship:
•indefinite leave (IL)
•permanent residence under the European Economic Area (EEA) regulations

Given this you should normally only register a child under section 3(1) who has not been granted IL or permanent residence where there are strong compelling compassionate circumstances to do so. British citizenship does not give a minor any additional benefits that cannot be obtained through IL and therefore representations on the basis of issues such as access to education are unlikely to be sufficient to justify the exercise of discretion
