Hi,

My son's are dependent on my wife Tier 2 general visa and their visa is expiring on 16th Jun 21. I have applied for LongTerm (10 year) route ILR and my appointment is due on 1st Jun 21. I can file my son's British passport as soon as I get ILR but in case i don't get decision on my ILR application before 15th Jun 21, do I need to extend my son's dependent visa? or if they are not planning to travel out of country, I can just wait for my ILR to come and then apply for their British passort directly? Can there be some complication for not having valid visa till their British passport application?

Thanks for your answer in advance.

Regards,
NG

If son was born in the UK, then he will be entitled to register after a parent is granted ILR. Else, they expect both parents and child to have ILR and at least one parent successfully applying for British citizenship.

Hi vinny,

Thanks for reply. My both son born in UK. I know they are entitled to british passport as soon as one of the parent gets ILR. I have applied for ILR and my appointment i son 1st Jun. Not sure how long decision will take but as my son's visa is due to expire on 16th Jun, my question is that is it must to file their visa extention? or they can stay without visa for few days/months before applying their British passport?

Regards,
Nishant

They cannot apply directly for a British passport before they are British.

However, UK born children are entitled to register, immediately after a parent is granted ILR. Children’s extensions are unnecessary.
