Hi

my friend is applying for Naturalisation. He was stopped by police last month and officer stopped him that he was on the phone while driving but in fact he was not on the phone. He got a police notice and he appealed against the decision .He is waiting for court hearing .

Does he need to mention this incident on naturalisation form? as he is waiting for court hearing and he does not know what will happen in court ?
please advice

Since he has appealed the ticket, IF he is found guilty by the court and a fine or penalty is imposed by the court, it will be equivalent to a criminal conviction. Your friend will have to wait 3 years for Naturalisation from the date of conviction.

If he wins, obviously no issue.

He must declare the incident in the form if he plans to apply now. His application will be kept on hold till a decision is made by the courts.

It is best to wait till a decision is reached by the courts to avoid disappointment or loss of application fees (if refused).
