Baby British Citizenship / Passport

Hello,

I am an EU national and have lived in the UK since 2004 when I was 12 years old. My wife is a non-EEA national.

My child was born in December 2019 in the UK and a month later my Settled Status application was accepted, and my wife's too.

I want to apply for a British passport for my child but I am not sure whether we even qualify or do we need to first apply for British Citizenship for the child?

Even though I have lived in the UK since 2004, I have never officially had any document confirming my settled status until after the birth of my child when I applied for the EU settled status scheme.

Can anyone advise, please? Many thanks in advance!

Did you work, seek work or have private health insurance (or any combination of the above) for at least five continuous years before the birth of the child?

Alternatively, while you were between the ages of 12 and 21, did your EEA citizen parent do any of the above for five continuous years?

Have you ever been absent from the UK for any period of time longer than six months and if so when?

Thank you for your response:

I was working for 4 years and 6 months when my child was born.

I was an undergraduate student before that but did not have private health insurance.

I was actually looking for a job throughout my final year of uni and I luckily did find one and started working a few weeks after my final year exams were finished.

Regarding my parent, I don't think so.

I was out of the country for 1 year between 2013/2014 to do my undergraduate placement year abroad.

Would you have proof that you were seeking work for about six months before you started working?

If you can cobble together this proof (work + seeking work for five continuous years before the birth of the child), you may be able to apply for the child's British passport directly.

The only proof that I can show is the emails that I sent with my CV attached when I applied for vacancies.

Some emails are confirmations through Indeed and other careers websites saying that I successfully applied for the job, most of them are just normal emails that I sent out saying that I want to apply for this position and attached the CV.

Do these emails count as proof?

Not entirely sure. It is worth including them, along with a cover letter stating that you are claiming that time (not exceeding six months) as a job-seeker.

See Table B of the Treaty Rights Passport Applications Supporting Documents guidance for more detail of what the Passport Office expect to see.

Keep in mind that you must show that the five continuous years of exercising Treaty rights occurred before the birth of the child.

Thanks for the help, that document helps a lot.

I will apply for a British passport for my child and send as many documents as I can and hopefully, it will work.

If it gets rejected, will this affect anything in terms of applying for British citizenship? I presume I just lose the fee that I paid and my documents would all be sent back to me, right?

If it does get rejected, does that mean that we first need to apply for British citizenship for my child, then wait a year, then apply for the passport?
