British Citizenship- Domestic violence

Dear All,


Can someone please kindly advise the following query as I am getting mixed responses.

I came to UK on student Visa - 2009
Married to British citizenship- 2016 in UK
spouse visa - 2017 as under 5 years rule (applied from India and entered in UK Feb 2017)
spouse visa Extension -2019 (Until may 2022)

Domestic violence and got ILR on DV - Sept 2020
Divorce applied - Nov 2020

Right now I am still in process to get divorced due to covid everything is slow.

can I apply for British Citizenship after 30th Sept 2021, I have booked Life in UK test for next week and I have done my master from university.

As a victim of DV, do I need to wait to cover 5 years residence requirement ( Feb 2017- Feb-2022, when I entered into UK as on spouse visa) or what are the requirements for DV?

I spoken to few solicitors and they all have mixed answers.

There are no special/separate provisions for British citizenship for people who have suffered from domestic violence.

In particular, you will still have to meet the physical presence five/three years ago, which is a mandatory requirement that the Home Office has no discretion to disapply.
