Naturalisation query

Good Morning,

Asking for a friend.

She has submitted the application for naturalistion on 12th of this month and has the biometrics appointment booked for next Tuesday.

Can someone please reply to the below:

1. She was granted ILR in 2015 under the spouse route and her husband is a British citizen. She wasn't physically present in the UK on 12/Sep/2018 and thought she would fall under the 5 years route. Is this correct?

2. Also she doesn't have a NARIC/ECCTIS letter to confirm the level of English required however she has a certificate from an Indian university confirming the medium of instruction as English. [/list]

3. The checklist generated after submission clearly asks for NARIC/ECCTIS letter, husband's British passport copy and marriage certificate so I suspect she falls under the 'spouse of British citizen' route and needs to be physically present on the same day 3 years ago. She was away from the UK from Sep18 to Feb19 so we are not talking about few days here.[/list]

4. As she has submitted the application on 12/Sep/2021 and not being present in the UK 3 years ago on the same day, would this be a potential refusal?[/list]

5. She is about to apply for NARIC/ECCTIS letter today and is likely to receive it in 3 weeks. Can this be sent after biometrics date? [/list]

6. Worse case, if it is likely to be refused, can she withdraw the application and refunded by anyway?

It will really helpful if someone can respond please.

if she is eligible on the 5 year route she can choose that option and not rely on her marriage to a British citizen but this should be clearly stated in a cover letter uploaded with the application.

The NARIC letter is essential and if it is expected in the near future consider postponing the biometric appointment.

yes, she can cancel the application online and the application fee and the IHS will be refunded provided she hasn't attended the biometric appointment yet. The guidance on cancellation is here:
