Hi,
Section 1(3) - A child born in the UK whose parents are not British citizens and were
not settled in the UK will have an entitlement to register when one of their parents
become settled in the UK or become British citizens.

I will be eligible to apply for ILR in January 2025. According to the clause mentioned above how long my baby can stay each year abroad to be eligible to get citizenship after 5 years with me?

I have also read the following on gov.uk for child born in uk.

You were born on or after 1 July 2006

You can register to become a British citizen if, when you were born, neither of your parents were British citizens or settled in the UK.

You must not have spent more than 90 days outside the UK in each of the first 10 years of your life.

There is NO absence limit for children born in the UK who apply for citizenship.

Please can you also tell how long I can stay abroad. My BRP issue date is from 20/01/2021. I'm on maternity leave and planning to go to home country from 27/11/2021to 12/03/2022. if it is 180 days each year then next 90 days would fall in 2022?

You are reading the wrong I formation. That is for form T and NOT MN1 section 1(3) registrations.

MN1 section 1(3) has NO absence limits.

It depends what visa you hold and what route of ilr you are planning to apply through. Different routes have different rules!!

It depends what visa you hold and what route of ilr you are planning to apply through. Different routes have different rules!!

I’m on Tier 2 visa (skilled worker) after 5 years of stay I can I’m eligible to apply for ILR for me its 450 days in total I can spend abroad and I’m not sure if it is 180 days each year can you clarify that?

And for baby am I eligible to apply for her ILR or citizenship at the same time duration? How many days she can spend abroad with me? Which route should I follow for her and thinks to keep in mind beforehand? Would she directly get a passport after 5 years?

A parent’s ILR is sufficient for a UK born child’s registration under Section 1(3).

A Skilled worker or Tier 2 (General) holder may break his/her continuous period for ILR, if absent from the UK for 180 days or more in any rolling 12 month period within the qualifying 5-year period for ILR.

There are also absence limits required for an adult naturalisation under Section 6(1).
