Hi,

I tried to read existing topics to get answer, But i'm not successful. So, posting this query. Apologies, If it is repeated.

I have ILR since 2014
My wife got ILR after 5 years spouse visa last month.
Our 2 kids was born in UK, they have british citizenship.

My elder child was born out side UK before my ILR. He traveled to UK on July 2012 and living here in UK (9 years and 4 months). He had 5 years dependent visa which expire last month.

Can my son register (MN1) as he was born outside the UK - at the "discretion of the Home Secretary" section 3(1)?

If yes then what documents are required?
If no what options are available ?

Many thanks

The child needs ilr first and can only apply for citizenship when either parent also applies or is already British.

Why have you let his visa expire and not applied for ilr for him?

Apply for SET(F) first.
