Hello everyone,

Can you please provide your advice on the below issue?

I have got ILR after my child was born in the UK, and my husband is still on tier 2 dependent visa.
My child has also got tier 2 dependent visa and is due to expire next month. She has not completed 5 years yet, so won’t be eligible for ILR.

So, I have couple of q’s if you could help clarify please?

Should I apply for her tier 2 dependent visa extension to cover remaining period before she is eligible for ILR?
Or Can I straightaway apply to register her as a British citizen (via the MN1 form) and apply for British passport i.e there is no need to get visa extension or get ILR first? If you have ILR and your kid was born in the UK you can register that child on form MN. No requirement that a UK born child should have ILR before applying to register as a British Citizen. Child wouldn't be able to use the NHS until that pulls through though.

Also, I read there is a rule that a child should not have stayed more than 90 days outside UK in each year from the time child was born in the UK. Is this a "must have" requirement? Actually my child has stayed outside UK for more than 90 days in 1 year, so what can be done in this case?Never heard that before. 90 days outside the country isn't a problem.
