My new born and British Citizenship

Post by Tochim » Mon Jun 20, 2022 1:37 pm

I have indefinite leave to remain and my enquiry is this; My child has just been born. Is he qualified to get British citizenship since I have permanent stay?

Yes. Apply to register your child as the link below

Child is automatically British if born in the uk to a parent holding ilr.

That means, if the child is not born here even if you have IFR, the child will not be qualified for citizenship?

If the child is born abroad then the child is not british and cannot apply for British citizenship yet either.

What visa does your spouse hold?

If child is born in the UK to either parent with ILR;
  • In the UK
    • The child is automatically a British citizen and can apply for a British passport directly.
  • Outside the UK
    • The child is NOT a British citizen and will have the same ILR status as the second/less privileged parent. The child will have to apply for the same visas as the second parent, apply for ILR with the second parent and can then register as a British citizen, after both the child and second parent get ILR.
