90 Days out of UK Discretion

Hi Guys,

I do understand about the 90 days period in last 12 months when applying for Naturalisation.

I also read about the 100 day discretion bit but had some questions.

So my situation is :
in last 12 months wife was out of uk on 2 occasions
1) 15th july 2021 she left and got back on 14th oct 2022
2)15th march 2022 and got back 27th march 2022

so if I calculate period / no of days for the first time she was out, it amounts to 91 days
15th july she left, so does that mean actual day she was away would start from 16th july and considering she got back on 14 the oct, would her last day would be 13th oct
so technically speaking she was away from 16th july to 13 oct which amounts to 89 days ?

and for second time, the same situation, would it be from 16 march to 26 march which amounts to 10 days?

So a total of 99 days as opposed to 103 days, is that righty calculated?

and would it be okay to apply for under discretion ? if yes, what are the chances? and how it is considered ?

or perhaps to be on a safer side apply after 15th oct ?

any thoughts / advice?

Only whole days outside UK to be counted. Dont count days of travel as she will have been in UK for some time on those days.

So with regards to exercising discretion due to being over by 9 days ? How does that work, as in what all points they factor into consideration?

Or the best option would be to wait till mid October and then apply?

In your shoes, except if there are things that makes it absolutely necessary to apply now and be at the mercy of discretion would rather wait till October.

As per page 11 on https://assets.publishing.service.gov.u ... rocess.pdf absences upto 100 days are normally disregarded. When I applied I had 97 days outside uk in last 12 months. Application was approved. We didnt have any other issues with our details everything was straightforward.
