MN1 Form - question on settled status

Hi,

I got my ILR in June 2022. My husband is holding dependent visa (Dependant Leave to Remain) until July 2024. He used to have a Tier 2 visa but switched his visa which reset his qualifying years. He is not applied ILR yet as he hasn’t completed his 5 years as my dependant.

My son was born in UK and I’m going to apply for his naturalisation under section 1(3) birth in the UK to parents who are now settled in the UK or have become British citizens

Below is the question from MN1 form

Is this parent settled in the UK? Date this parent became settled in UK

I answered yes, to this question for myself as I have ILR and I put my ILR approval date which also matches the date on my BRP.

What would be the answer for my husband as he is holding Dependant Leave to Remain visa?

If the answer is yes (as he is living in the UK together with us), what would be the date he became settled in UK?

If your husband doesn't hold ILR I believe the answer in his case is "no". ILR is what defines settlement.

I found an explanation on the internet which confused me

What is settlement and non settlement visa?
While Settlement Visas (like Tier 1 General or Tier 1 Entrepreneur or Old HSMP Visa) allow you long period of stay leading to Permanent Resident or Indefinite Leave to Remain in the UK, non settlement visas are for shorter periods and do not lead to Permanent Resident status.

This is incorrect, not sure where you read that but there is a lot of misinformation in websites that are not official websites.

For the purpose if the child's MN1 form, your partner is NOT settled as they do NOT hold ILR yet and you should answer NO to the question

Good evening all,

I have made an online application to register my son born here in UK as British Citizen. One of the parents has ILR. After paying, a few consent forms show up for download and signature. Please provide guidance on the following document template to be signed https://visas-immigration.service.gov.u ... onsent.pdf.

PART 1: Consent for the Home Office to verify application information
- To be signed by the applicants. As my son is 9 years old, should I put his name as applicant and then parents to sign on their behalf?

PART 2: Consent for the Home Office to verify third party information
- To be signed by 'join owner' whose information has been provided in addition with applicant.
Should both parents sign this as their information?

PART 3: Consent for the Home Office to verify information from third party sponsor
- To be signed by person who is to provide the applicant with financial support
As kids are financially dependent to the parents, should parents sign this part as well?
