Hi,
I have children born from my British ex-husband and I was wondering if they are automatically citizens?
He has asked for us to travel to the UK so he can see them as he has to take time off work to come here.

I'm Australian so that's not an issue entering the UK but our 4 kids born abroad have no passport.

I'm at a loss, I thought because he is a British citizen, I just have to apply for their passport with a translation of their birth certificate and their father's Full British birth certificate.
Then I read I must apply for their citizenship first and then their passport!

Please can I have some clarification?

If your ex is British born (in the UK) to British parents, then the children are automatically British by descent.

If he was born abroad to British parents, then he himself is British by descent and his children born abroad are not automatically British.

Are the kids Australian citizens? If so you can't you also just go ahead and apply for Australian passports which are fine for visa free travel to the UK?

If your kids are British born it is a good idea to apply for their first passports before you receive their Australian ones. The reason is that you will have to send off their Australian passports, but only if you have any, to the UK authorities when you apply for their British passports. This would prevent the kids travelling to the UK, using their Australian passports, while waiting for the UK passport application to be processed.

When was the father born?

If he was born before 1983, then just the birth certificate is sufficient.

If he was born in 1983 or later, you will also need proof of his parents (the children's paternal grandparents) status (as either British citizens or as resident in the UK on ILR) at the time of his (the father's) birth.

CORRECTION: Passport applications from overseas only require full copies (all pages, including blank ones) of other passports. My mistake. It is citizenship applications from overseas which require original foreign passports, not passport applications from overseas)

After reading the later replies and this I'm very confused.

Our children born abroad are citizens of the country they were born in.
My ex husband, their father was born in the UK in 1987 and his parents were living in the UK for a few years prior to his birth as residents.

My children born in the UK got their passports just with their fathers birth certificate
I don't understand why I need to register them for citizenship if their father is british

The children have no passports
only the children born in the UK have expired British ones

It makes no sense to have some kids travelling on British ones and some on Australian ones
plus I believe the process would be the same being part of the commonwealth ?
how can it be so confusing

So on the website it says I need to supply this as evidence with the application!
I don't even have these documents they aren't common here and the whole reason I'm making their passports to leave is because their father never registered me for residency here ( basically I'm here illegal and when married I couldn't register for residency myself without him doing certain things)
I have a passport from Australia
Australia birth certificate
Australian change of name certificate
Lease agreement in Arabic
divorce papers in Arabic which show our names
Birth certificate of children in Arabic
Hospital paper in french stating the child was born and the drs name
My kids don't attend school as their father never registered them, I had to do that in order to get my divorce!

He won't apply for their passports and Australian passports require fathers' consent, as far as I know, British ones don't require both parent's consent.

• parents’ marriage certificate (this does not apply for those born on or after 1 July 2006); and

I read I need to apply for my children's citizenship for their British passports!!!
but they are British due to their father being born in the UK

British citinzip applications cost over 1300 GBP and can take months!

British embassy has not replied for 3 weeks and they are no help at all!

My children were born abroad

the supporting documents seem to be for an adult but not a child. So how do I know what to submit for the supporting documents?

If father was automatically British and was born from 1983, then also include evidence of his parent’s British citizenship or settled status when father was born.

yeh thanks I have gone over these supporting documents and guidelines so many times but it doesn't make sense in terms of a child application and what I'm capable of providing as a mother based on the country I live in

Like how do I provide a photo id for a child? for a 11-month-old?
I wear a face veil so I don't really have many pictures with my kids outside without my face covered. at home I have no head covering at all, but then again I'm usually taking the pictures of my kids and not in the picture itself! so then why are they asking for pictures of me with my children when I have court documents for divorce and custody etc etc
this is just so confusing and unnecessary

When I check the supporting documents i need for the application it refers me to group 3
this asks me for the following which seems impossible for a child passport application. It asks for pictures with my children from birth to the current day.
Most of the time I take pictures of my children and I'm not in the picture. I don't have any pictures showing my face with my children !!!!

Hi,
I'm about to apply for first British passport application for my children.
My ex-husband (British born) is not cooperating at all, I'm Australian born. I gave birth abroad and I'm trying to apply for first passport

He won't consent to Australian passports at all, he won't consent to anything! British passports don't require his consent as I'm their mother, but his name is the issue.

I have his British birth certificate in my hand and see that his middle name has 2 letters spelt incorrect (likeness to his legal middle name but spelt incorrectly on his birth certificate)
I applied for a new one based on his passport details and they said there is no birth record of him!

I have derived the fact that he either willfully uses the incorrect spelling or has legally changed his name.
He won't reply, he won't cooperate, and I'm stuck in North Africa to where I'm not a native and I'm not allowed to legally stay anymore, and he is in England!


I was told I must submit his birth certificate when applying for their first British passports.
but his name doesn't match his passport and photo ID, nor does it match his name on our British born child's birth certificate. I just applied and received her passport using a photocopy of his passport and her expired passport plus her birth certificate.

Will the HMPO grant kids their passport like this? or will they refuse it?
it's impossible, I can't be stuck here forever with my children!
please help advise me what to do

i have not made their australian citizenship as it takes almost a year and is costly but australian passports require both parents signatures with witnesses and he refuses.
