Baby Born Abroad

Post by bling-uk » Mon Jan 23, 2023 1:08 pm

Hi All
Need some advice for a baby born outside of UK.

Father is British Citizen and Mother has Indian Passport with ILR

Baby is born in India. What is the best/quickest option to get the baby to UK?
Has anyone else gone through same ?

Any tips will be greatly appreciated.

Thanks in Advance

Are you British through naturalisation?

If yes, apply for Certificate of Entitlement to Right of Abode. It can take up to 16 weeks to process etc. Child will need an Indian passport to do this.

Hi Cr001,

Thanks for the quick reply.

Yes I am British by Naturalisation.

If the Child gets Indian Passport and the Certificate of Entitlement to Right of Abode.
How do we get British Citizenship for the child and what are the steps involved?

The child is automatically British by descent.

understood that child is British.

Rephrase of question - how do we get British Passport for the child?
What age can we apply for the Passport - is it immediately after we reach UK?
Do we have to wait for certain years?

Thanks

You can apply for a British passport in India. They take 6 to 12 months, which is why I said do the Coa.

Once the child is in the uk, apply for a British passport. Coa is much more expensive than a passport so be aware of that.

Just to be clear.
Once we are back we can immediately apply for the passport from
https://www.gov.uk/get-a-child-passport ... d-passport

And while filling in the form
On the below - I say yes - as I will have the certificate and progress the application?

Do you have a naturalisation or registration certificate?
You’ll only have one of these certificates if you weren’t a British Citizen at birth, but applied to become British through the Home Office. This isn’t a birth certificate.

Thanks

It is NO to this question. A certificate of Entitlement is NOT the same as a naturalisation or registration certificate.

It clearly says if you weren't British and applied for british citizenship. This doesn't apply to your child as your child is British by descent.

Once you make it to the UK if you decide to apply for CoE from India, you can apply for a British passport directly for child.

You would need your British Passport as proof that your child is yours, hence British by decent.
Child foreign birth cert to show that child is yours.
Child's foreign passport, so that name can be duplicated exactly the way it looks on a previously issued govt. document.

Also note that the previously issued CoE of RoA would be cancelled, as child can't have both British Passport and CoEofRoA. You can only have one or the other.

Hope that is now clear enough.

Your British passport is what shows that your child is British. No other document.

Not necessarily, see post2014536.html#p2014536

Not in this case, where the child has made it into the UK with a sticker stamp showing CoE to RoA.

Parent British passport should suffice.

If child had ILE then that's different.

For child to get CoE of RoA from India. British citizenship would already been proven beyond reasonable doubt. In whatever shape, size or form.
