British Passport

Hi I am applying for my first British passport after naturalisation but I don’t have my overseas passport which was lost before I applied my asylum application 10 years ago and I never applied a new passport and also never travel abroad.My question is that there is a requirement from HMPO to provide your old passport but I don’t have one. Can someone have the information related to this please 😊

It's not an issue not having a foreign passport (valid or expired), for whatever reason. It not a condition for issue - British born people applying for their first passport don't have a prior passport either ....
If you have a Home Office Travel Document submit that and also enclose an explanatory note, whether you have a TD or not.

Have you got a travel document issued to you?

No, Never applied for travel documents.Only had the BRP card which returned back to Home office after Naturalisation Ceremony.

I applied on the 23rd of Feb.

Note that HMPO doesn't stipulate that a dual national "must" provide a foreign passport - in their policy guidance they use the wording "If a customer provides a foreign passport ....". They are used to applicants submitting a TD.

I totally agree with you. I have read all their passport policy guidelines and it does only say if they have a foreign passport - they should submit it. The issue is, it seems their ‘internal procedure’ is really ‘persist asking for foreign passport even if not available’?

Very stressful situation. My immigration history is very complicated as started out as child refugee, ended up on FLR and all my immigration applications accepted my non straight forward immigration history.

I wrote a cover letter, sent them expired TD (note this was CoT not Refugee convention) and my HO SAR showing my immigration history summary. I also sent marriage cert. And was still sent an email to send my foreign passport, travel document or national ID…I believe this email was a manual one not automatic (did not show on tracking) and had QR code so someone had to input it as Returned query.

I am just slightly stressed as surely the examiner should have read everything and not have requested what I already have said I do not have.

When I saw this person in similar situation, was like yaaaay!!

Any prediction on what is going to happen?
I called on Friday and let them know and they said they will put note on file. I called again on Sunday and was told to stop calling as otherwise they would flag my app and send it to the bottom of pile…my wife wants to complain, but I said no, no reason to annoy them further.

Ahhhhh after years and years and many ££££ and stilllll far far away…

I haven't been back to birth country since I came here…I was hoping with the Brit passport, I could finally go and get my documents sorted. I need to be physically there for finger prints and court. I left as a kid (parents deceased), brother in UK. So I do not even have my birth certificate.


😅😅😅😩😩 hoping in the next 1-2 weeks. Hopefully this person responds and tells us their experience.

If you read my previous post,

I just got another email from passport office to send foreign passport or travel document.

Any ideas how to move forward??

There are glaringly obvious reasons or legislation where a (former) refugee can’t hold/use his/her foreign national passport.

Refugee Convention ceases to apply (cessation)
339A. This paragraph applies when the Secretary of State is satisfied that one or more of the following applies:
  • (i) they have voluntarily re-availed themselves of the protection of the country of nationality;
They should have no expectations of a (former) refugee obtaining her/his country’s passport, as illustrated in an archived application for a Home Office Travel Document.
You must show that you’ve formally applied for and been unreasonably refused a passport by authorities in your country, unless you have permission to be in the UK as a refugee or stateless person.
If a person has permission to be in the UK as a refugee, then the “unless” condition applies. i.e. they should not require her/him to show that s/he has formally applied for and been unreasonably refused a passport by authorities in her/his country.

Else, if a (former) refugee does hold a foreign national passport, then this may be a ground for revoking refugee status and possibly a subsequent British citizenship, due to fraud!

Congrats - good to see that HMPO do get to the correct decision applicable to the circumstances.
