Good morning,

My wife arrived on a fiance visa in 2008 and got ILR in 2010. She worked in a care home from 2016 until she got injured. Until now, she has not had a BRP but is in the process of applying for one for her new role.

Questions on Citizenship
1) Her previous marriage was annulled. We submitted her marriage certificate showing her annulment in previous applications. Do we need to submit it as part of form AN, it doesn't appear to be the case
2) It is only recently we understood the new requirements for using a BRP to prove right to work. Her previous employer took her right to work using her ILR vignette. We are now applying for a BRP. Would the fact she worked without a BRP for 2015-2022 be construed as working illegally? Would this impact Citizenship application because we were in the belief that we were working legally because of ILR status
3) BRP - will that be refused because of point 2? Why does BRP take 6 months for settlement - is it a new visa application (ILR took 6 months too) because we thought it was only transferring a visa from vignette to biometric card.

3. No. UKVI have to check she has not list ILR status etc and it takes long as they are generally less priority than visas. It is not a new visa application.

Thanks CR001 for the speedy response and that is re-assuring. I felt it was something like that because we don't have to pay for the BRP as it will end in 2024 anyway.

So, when applying for Citizenship, her annulment will not be reviewed by us sending documents. Does that mean that the HO will go directly to her Embassy to confirm her annulment, or is it taken as read from the fact we are married, and have gone through 3 visa applications so it has already been reviewed multiple times?

Apologies for asking again.

Because we don't have to supply copies of my wife's marriage annulment information as issued by court in Thailand, and because this has already been revisited in previous visa applications, would the HO speak to the Thai courts to reconfirm, or will this not need consideriation as part of the naturalization process because it has already been considered in our numerous other applications. ILR was granted in 2010.

The reason I am asking is that, if they do that, then I think we should include the documents relating to her annulment because that will potentially speed up the process.

Your partners marital status has no bearing on her naturalisation application. She's had ILR for over 12 years.
She should apply in her own right under 5 years if she meets all other requirements.

I may be guilty of overthinking this because of the issues we experienced early on in our visa journey including delays and additional questions.

The ILR application we did was quite strenuous and, to be frank, put us off applying for citizenship until now.

Based on the form AN, it doesn't seem as arduous as the ILR application we made in 2010. My concern is really around not facing additional delays while information may be sought from Thailand and if I could facilitate this I will.

In that regard, would it be wise to not include the additional information (i.e. Court Judgments) around her previous marriage being dissolved. If not, is this information that is then passed to the UK from Thailand as verification. If so, then I know this will be delayed because the Thai authorities take ages to respond.

We don’t know what information sources UKVi use and what info they seek.
The application is generally straightforward with very few documents required. It’s not immigration rules that govern this.
Suggest fill in everything gather the normal documents and only add anything that will absolutely be necessary. You may have noticed that the application doesn’t ask to prove every fact you state.
