MN1 Application and school attendance

I will be moving back to the UK next month with my 8 year old son, who has American and Italian citizenship. I will be applying for his British registration under the MN1 (I received my British citizenship by descent...have successfully registered my two older children this way in the past from outside the country).
My question is...once I submit the application from inside the UK is he legally able to attend a state school in the UK, or will he not be able to do so until the application is approved and he is registered as a British citizen?

Universal access to education, does not need to be a BC before child can attend state school.

Ok, thanks very much. So as long as he's in the country on a valid visa while the MN1 processes he is allowed to attend school?

MN1 in progress or naturalisation in progress do not confer any residency status until decided.

Now I'm totally confused! As long as he hasn't overstayed on the passport he comes into the UK on (Italian or American) is he, or is he not, allowed to attend state school? I remember being told by a solicitor that he could remain in the country while the MN1 was processing, even if it means overstaying, but can he go to school at any point or not? Thanks!
