SPOUSE VISA – sponsor working abroad

Good day, everyone!

I am the sponsoring partner under the UK Spouse Visa.

I’ve received a very good offer to work abroad. The job contract is for two years, then I will go back to the UK.

My husband was granted a spouse visa in June 2021 and has just started his 3-year route before he can apply for citizenship and therefore cannot be absent from the UK for more than 270 days.

If I relocate to work abroad for a couple of years, he can come and visit me every single month.

Will a long distant relationship be counted as living together if my husband cannot relocate with me but comes to visit me on a regular basis?

If, by accepting a job offer and relocating to work abroad, I am risking jeopardising my husband’s ability to settle in the UK, I’d rather stay here. I am just trying to understand what the consequences can be.

Any thoughts/advice will be much appreciated.

The path to apply for British citizenship is 5 years, not 3 years and your husband will only be entitled to apply for BC once he has been granted Indefinite Leave to remain after a successful application under SET(M). Your husband will first have to apply for a 30 months FLR(M) extension before his current visa expires.

In the FLR(M) application you will be required to submit documented evidence that your relationship is subsisting. This will include submitting 6 pieces of evidence in joint names as proof of joint address, together with financial information showing that you have a minimum income level of £18,600 annually.
You, as your husband's sponsor are expected to be residing with him in the UK, so before you make any irreversible decision that you read through the information in the link posted below.
