British citizenship 3 years vs 5 years

Hi everyone
I have few questions regarding the options 5years/3 years for British citizenship

My husband is a British passport holder and for me i should wait till December (90 days absence for the past 12 months) before applying for BC
I wanted to apply for the BC as a British citizen wife but unfortunately i have been absent from the uk for 260 days in the past 3 years and now i am outside the uk.

For the 450 absence in the last 5 years i meet the absence requirement.

Do we have the same chances to get BC for both options! knowing that i am not working and never worked in the uk?!

IF I AM NOT WORKING, WILL THIS BE A DISADVANTAGE ???

Is it better to choose the 3 years option? if yes, i should return to the uk this week to meet the 270 days requirement for the past 3 years
I am very confused.

There is no income or employment requirements for citizenship as it is not an immigration application.

Regarding the 5 years option, Yes, i have held my ILR for one year but i have to wait till December because i was absent from the uk for more than 90 days in the past 12 months

I know that when we are married to a British citizen, we can apply for BC just after having ILR but i have to wait till December as well, because i was absent more than 90 days during the past 12 months

apart from what is mentioned above, is the way to apply for BC the same with both 3 years option and 5 years one? if no please let me know which option is the best

3years - you apply based on your subsisting marriage to British Spouse so need to present marriage cert, spouse's passport/naturalisation cert as part of documents to upload.
5years - you qualify in your own right with no need to refer to spouse and or the documents mentioned in 1. above.

So if i understood well, the second option( 5 years) is better because it seems to be less complicated!!

It depends on what you mean by "complicated" . If the needed documents for 5years are readily available then not complicated.

I just want to confirm one point regarding the referee for BC application

Please correct me if i am wrong!

On the referee declarations we have to put the applicant's photo, not the referee photo?!!!

Hi everyone

I am very confused and need your help :|

I was about to apply for naturalisation on the 15th of February 2024 but due to health issue i stayed 106 days in my home country ( so i spent 16 extra days than the 90 days allowed in the last 12 months before application)

And because of these 16 extra days i have to wait until September 2024 before applying and my passport will expire in September 2024

My question is:

IS THERE a chance that i can still apply on the 15th of February or i have to wait one year just because of 16 extra days ?!!!!!

Up to 100 days are normally disregarded. Per An Guidance: https://www.gov.uk/government/publicati ... n-guidance
Above a 100-179 days: "Total number of absences normally disregarded only if all other requirements are met and you have demonstrated links with the UK through presence of family, and established home and a substantial part of your estate."
I would be best if you want to apply in February to explain why you are slightly over the 90 days - clearly your choice.
Note if you apply just before your passport expires it's ok as long as passport is valid on the day of application.

As for the estate we have been renting since more than 6 years and the tenancy agreement is signed with both our names .

In addition the council tax is as well on both our names and we have a join bank account
Will it be sufficient or not?

Will it be sufficient or not?
Estate is reference to home and or other property you own.
If you proceed, your application will be at discretion of the SoS for Home Department, provide as much as you can.

I forgot to mention that the main reason for me not to come earlier was related to an accident i had which resulted on me breaking my leg and had to put a cast. the doctor has recommended to stay put and not travel for 45 days. I do have the medical report with x-ray/CT scan which prove my fracture.

Should I add this event on my cover letter?

But I have heard that adding such event on my application may have a negative effect and will results on delaying my application further than a year

Who says that? And consider, 16 days over is minor on the face of it. But if you are really not sure why not wait until September 2024? Then you wouldn't have to worry about it.

I want to get the British passport as soon as possible for a personal reasons

So i will apply in February, providing all the proves of my delay. Hoping it will work :(
